Digital TV Switchover – Information for Landlords

How will I be affected by the switchover?
If your tenant is currently receiving TV signals through a TV aerial system, the system will need to be upgraded or adapted to receive digital signal.

As a Landlord, is it me or my tenant that is responsible for upgrading the equipment?
It depends on the provisions of the tenancy agreement as to who is responsible for the aerial. Check your tenancy agreement to see if it tells you whose responsibility it is.

What if the tenancy agreement does not make any reference to whose responsibility it is?
You will need to check to see whether there is a service charge schedule. If there is a provision in the schedule for provision/maintenance of TV services then you will be responsible but will be entitled to recover a proportion of the cost from your tenant.

If there is no provision at all, then a practical way forward would be to approach your tenant to see whether they would be willing to meet the cost of upgrading the equipment.

The agreement says I am responsible but I do not want to arrange or pay for the works required to upgrade as I feel the tenant should pay if they are to benefit.
If it is your responsibility under the terms of your agreement your tenant could take legal action against you through the courts to enforce the terms of the agreement.
