2025 New Year’s Resolutions: moving on with a divorce or separation
By Rob Colwell, Director, Hayes + Storr
The arrival of a new year often inspires individuals to make positive changes in their lives, and for some, this might include the decision to end an unhappy marriage or relationship. While separation and divorce can be a difficult and emotional process, New Year’s resolutions can serve as an opportunity to reflect and take the necessary steps toward a fresh start.
In the UK, the process of divorce is governed by specific legal requirements, and the recent changes to divorce law can make it a bit easier for individuals to move forward. As of April 2022, the Divorce, Dissolution and Separation Act 2020 came into force, allowing for a “no-fault” divorce. This reform eliminates the need to prove fault or assign blame, making the process more straightforward and less adversarial.
Solicitors at Hayes + Storr follow the Resolution Code of Practice, meaning they will not only explain all the options and give you confidence to make the right decisions, but help you balance financial and emotional costs with what you want to achieve. Our aim is to help you manage stress in what can be an already stressful situation.
Here are some key steps individuals might consider when starting their divorce journey as part of their New Year’s resolution:
- Reflect on your decision: Before filing for divorce, it’s important to be sure about the decision. Reflect on the reasons behind the choice and seek counselling or legal advice if unsure.
- Understand the legal process: The divorce process in the UK begins with the filing of a divorce petition. Under the new law, couples can apply for divorce jointly, reducing the stress of a combative process.
- Consider financial and child arrangements: Sorting out financial matters and child arrangements should be a priority. Seeking professional help from a financial advisor and a family law solicitor can ensure that both parties reach a fair resolution.
- Focus on self-care: Divorce can take a toll emotionally and physically. As you start this new chapter, prioritising self-care and seeking emotional support can be vital for personal healing.
