Injury to feelings awards

The Presidents of the Employment Tribunals in England and Wales and Scotland consulted on uprating the bands of compensation for injury to feelings in discrimination claims (referred to as Vento bands) following a Court of Appeal ruling that there be a general 10% uplift.  They proposed that the Retail Price Index (RPI) continued to be used as an inflation rate calculator.  Following consultation, the Presidents issued joint Presidential Guidance which applies to all claims presented on or after 11 September 2017. The new bands are:

• Lower band – £1,000 – £8,000
• Middle band – £8,000 – £25,000
• Upper band – £25,000 – £42,000

The Presidents will review, and if necessary amend the bands, in March 2018 and annually thereafter.
