There are two types of LPA:
Your attorney will only be able to act when your lasting power of attorney has been signed by you and your attorney and has been certified by a “Certificate Provider” who confirms that you understand the nature and scope of the LPA and have not been unduly influenced into making the power. It also needs to be signed by your attorneys. It must then be registered with the Office of the Public Guardian (“OPG”) before it can be used.
An existing Enduring Power of Attorney, validly made before 1 October 2007, will continue to be valid. It can only relate to your property and affairs and does not give authority to deal with health and welfare

In some cases, the appointment of an attorney is disputed. You can object to the registration of a Lasting Power of Attorney, if you know about it in advance, by contacting the Office of the Public Guardian (OPG). In the past, it was obligatory to notify family or friends when an application for registration of an LPA was made. However, this is now optional, so it may be that you don’t become aware of an appointment until it has taken effect. If you think that someone who is already appointed as an attorney is acting improperly, you can ask the OPG to investigate. If you are in this situation we would suggest that you seek the advice of a solicitor, who can guide you on the procedure and likely outcome.

Ed completed his work experience at a top law firm in Norwich. During his postgraduate studies Ed joined Hayes + Storr in March 2021 as a Paralegal in the Private Client Department. He started his training contract with Hayes + Storr in October 2021.
Outside of work, his hobbies include reading, travelling and long country walks along Norfolk’s coast.

She completed a Degree in Politics at the University of Exeter, and subsequently completed the Graduate Diploma in Law and Legal Practice Course at the College of Law, Guildford, obtaining her Law Degree at the same time.
She completed her Training Contract with a law firm in Sussex, qualifying as a Solicitor in February 2016, before relocating to Norfolk in early 2020.
Outside of work, Emma is a keen sports fan and can regularly be found attending football matches or getting out and about in the countryside.

John moved back home to the UK in 2006, having spent almost all of his life in Zimbabwe, where he qualified as a legal practitioner in 1975. Having completed his conversion exams, John was admitted as a solicitor in England and Wales in November 2007.
John and his wife are enjoying living in Norfolk and he lists his interests as first and foremost his grandchildren, followed by golf, watching most sports, travel and the flora of the UK.

Read moreKieran has lived near Fakenham for most of his life and was brought up in a family who worked almost entirely in different areas of the legal system. Therefore it comes as no surprise that he has been interested in law ever since he was a child.
He achieved 100% in his A-level law exams and went on to study an LLB (Hons) Law Degree at the University of Leicester. He then carried out his Legal Practice Course (Post Graduate Diploma) at Anglia Ruskin University where he achieved a distinction. He completed work experience at a top law firm in Norwich and joined Hayes + Storr in 2017 as a Paralegal. He started his training contract in January 2019 and qualified in December 2020.
Outside of work, his hobbies include playing rugby, going to the gym and visiting Norfolk’s outstanding beaches. He was the captain of the men’s rugby team at the University of Leicester in his final year.
