Child Arrangements

When a relationship breaks down, the most difficult issues often concern the arrangements for the children, such as:

• Where they are to live

• How much time they should spend with each parent or other family members

• Which school they should attend

• Whether one parent should be allowed to move away from the area, or even out of the country

There may also be disputes about holidays abroad and medical treatment.

The court has the power to make decisions about long-term arrangements for children, but it is far better for parents or carers to reach an agreement. We can discuss with you the importance of Parental Responsibility, and what the law says this means in practice.

We encourage parents to consider alternative ways of resolving issues, such as mediation (the cost of which may be subsidised by the government) or solicitor-led negotiation. Nonetheless, court proceedings are sometimes necessary to obtain a Child Arrangements Order, Prohibited Steps Order, or Specific Issue Order. We can guide you through this very difficult process, either through full representation or by providing unbundled ‘advice in the background.’

The H+S Family Department has extensive experience acting for parents as well as wider family members, such as grandparents, aunts, and uncles. We also regularly handle cases involving domestic abuse, mental ill health, and substance misuse.

Our solicitors also have experience advising in cases involving 16.4 Guardians (appointed to act on behalf of children) and Special Guardianship, where the local authority has concerns about parental care but aims to keep the children within the wider family unit rather than placing them in care.

We can also advise on maintenance to ensure you receive the appropriate financial support for your children, via the Child Maintenance Service (formerly the CSA).
